The K-1 visa allows the foreign fiancé(e) of a U.S. citizen to enter the United States for marriage. within 90 days of arrival. After the marriage, the foreign spouse can apply for adjustment of status to become a lawful permanent resident.
To qualify for a K-1 visa, the following requirements must be met:
- The petitioner must be a U.S. citizen
- Both partners must intend to marry within 90 days of the fiancé(e)’s arrival

- Both partners must be legally free to marry
- The U.S. citizen petitioner must demonstrate the ability to financially support the fiancé(e) by meeting income requirements or providing an Affidavit of Support
