Planning a wedding is an exciting time, but when your partner lives in another country, there’s an extra layer of complexity. The K-1 fiancé(e) visa is a great way to expedite your partner’s immigration journey. 

The K-1 visa allows the foreign fiancé(e) of a U.S. citizen to enter the United States for marriage.  within 90 days of arrival. After the marriage, the foreign spouse can apply for adjustment of status to become a lawful permanent resident.

To qualify for a K-1 visa, the following requirements must be met:

  • The petitioner must be a U.S. citizen
  • Both partners must intend to marry within 90 days of the fiancé(e)’s arrival
  • The couple must have met in person at least once within the two years prior to filing the petition. (Exceptions may be granted for extreme hardship or situations where meeting in person conflicts with cultural or religious practices)
  • Both partners must be legally free to marry
  • The U.S. citizen petitioner must demonstrate the ability to financially support the fiancé(e) by meeting income requirements or providing an Affidavit of Support
